Public liability insurance is intended for all companies engaged in the carriage of goods by road, whether nationally or internationally. This includes carriers that commercially or for remuneration transport goods by motor vehicles on public roads with a permissible gross vehicle weight exceeding 3.5 tonnes, including trailers.
A road haulage operator/carrier is any party that commercially undertakes the transport of third-party goods by land.
Insurance coverage applies, in accordance with the application, to contracts of carriage for domestic transports within Germany and/or for all cross-border transports to, from, and through the countries of geographical Europe, excluding Russia, Belarus and Ukraine, including the regions of Crimea, Luhansk (LNR) and Donetsk (DN).
Insured is the statutory or contractually agreed liability of the policyholder as a carrier for losses arising from all commercial, remunerated transports of third-party goods using all owned or hired motor vehicles registered under the policy, including transport-related interim storage.
Losses include damage to goods, loss of goods, delay in delivery, or other financial losses.
The insurer’s obligation to indemnify includes the settlement of justified claims for damages and the defence against unjustified claims arising under carriage law that are asserted against the policyholder in its capacity as the contractor of a contract of carriage.
Liability for damage to or loss of goods is bindingly weight-based in accordance with the statutory provisions of the German Commercial Code (Handelsgesetzbuch, HGB) for domestic transport, and internationally in accordance with the Convention on the Contract for the International Carriage of Goods by Road (CMR).
For domestic transport within Germany, the statutory standard liability limit of 8.33 Special Drawing Rights (SDR, approx. EUR 10 per kg) may be contractually increased to up to 40 Special Drawing Rights (approx. EUR 50 per kg).
Any party operating commercial road haulage using vehicles with a permissible gross vehicle weight exceeding 3.5 tonnes, whether individually or as a vehicle combination, is required under the provisions of the German Road Haulage Act (Güterkraftverkehrsgesetz – GüKG) to take out carrier’s liability insurance and to carry proof thereof in the respective vehicle in the form of a simple photocopy.
When requesting a quotation, the policyholder may choose a deductible of EUR 300, EUR 500, EUR 750 or EUR 1,000 per claim.
For damage to third-party trailers, swap bodies, containers, semi-trailers or similar equipment in connection with the carriage order, a deductible of EUR 1,000 per claim applies mandatorily.
The deductibles apply independently in the event of a claim.
The carrier’s liability insurance is taken out for a term of one year, expiring on 1 January.
The insurance contract is automatically renewed unless it is terminated in due time with three months’ notice prior to expiry.
Insurance cover applies to:
general freight, and, where applied for,
refrigerated and deep-frozen goods, as well as domestic CEP goods (courier, express and parcel shipments).
The following transports are excluded from insurance cover:
theft- and robbery-prone goods such as spirits, tobacco products, consumer electronics, telecommunications devices, IT equipment and accessories, and optical devices (e.g. digital cameras), each with a goods value exceeding EUR 50,000 per shipment and EUR 200,000 per trip and articulated vehicle;
precious metals, jewellery, gemstones, means of payment, valuables, securities, stamps, documents and certificates;
paintings, sculptures and other works of art or valuables with an individual value exceeding EUR 2,500;
radioactive substances, live animals, motor vehicles, household goods, and unpackaged commercial furniture;
goods transported as special transports pursuant to Sections 22 and 29 of the German Road Traffic Regulations (StVO).“
The policyholder must ensure that consignments are delivered only against a receipt signed by the authorised recipient, unless delivery without a receipt has been agreed with the principal. The burden of proof in this respect lies with the policyholder.
This insurance contract is governed by German law, in particular the provisions of the German Insurance Contract Act (Versicherungsvertragsgesetz – VVG).
For actions brought against the policyholder relating to the payment of premiums, payment of deductibles, recourse claims or for any other reason, the court having jurisdiction shall be the court at the place of the policyholder’s registered office or branch.
For actions brought against the insurer, the court having jurisdiction shall be the court at the location of the insurer’s competent managing office.
The contract language is German.
The contract and settlement currency is euro (EUR).
The policyholder is legally represented by the individuals authorized to act on behalf of the company, such as managing directors or authorized signatories.
